Discretion Granted to National Courts in Relation to the EU Legal Essay
Discretion Granted to National Courts in Relation to the EU Legal Order - Essay Example The body that was named as the European Court of Justice (ECJ) that enables the national courts to refer to it. The preliminary reference procedure has been essential in designing the fundamental principles of the national legal system, the unity of the member countries, and the development and maintenance of the national laws. In Article 234, the Court has the powers to give preliminary rulings in a request from the national courts. The preliminary rulings might be about the interpretation of the Treaty, the legality and the interpretation of the actions of the member countries and the European Central Bank. The national courts have therefore a vital role to play in the administration and how the community law is implemented. However, the European Union Treaty does not precisely define ââ¬Å"the national court or tribunalâ⬠. Nevertheless, it is vital to know that the national laws of the member states do not depend upon the definition of the tribunal or national courts by the European Court of Justice. The Court has the role to define the national laws of a given community. ... Moreover, different cases shall be looked upon in the preliminary ruling procedure (Arnull, 1989). The Right and Obligation to Refer Cases The case of Vaasen- Gobbel came up with the decision to define the national court in order to find a way to refer to the ECJ. The case was held by stating that any body making a reference to the European Court of Justice must satisfy a number of criteria: It first need to be established by law, must have a permanent existence, it must be in a position to practice a lasting jurisdiction, must work under the rules of the Community law and its procedures and should apply the rule of law. The Court therefore had to extend the stated criteria to apply to the national courts so that they would be independent (Komarek, 2005). Several other cases including the De Coster Case, enabled the college which previously had the powers concerning the local tax proceedings and never operated on its own nor made its own decisions regarding the process later satisfie d the criteria to operate as an independent body. The De Coster and CLIFIT cases demonstrate the national courts that have the powers to give judgment in relation to article 234 of the European Court of Justice (Komarek, 2007). Even though the case regarding the definition of the court or tribunal that satisfies the previously defined criteria for an independent body is at times inconsistent and therefore provides a room for some critics to disagree on which bodies are to refer cases to the ECJ. However, in order to solve this problem of disagreements, the European Court is coming up with the preliminary reference procedure that would be used by all judicial bodies while they might be dealing with cases involving the Community law (Maher, 1994). On the facts of the case, the De Coster and

The Pearl - John Steinbeck Essay Example | Topics and Well Written Essays - 1250 words
The Pearl - John Steinbeck - Essay Example The story takes a turn when the son of Kino named Coyotito gets stung by a scorpion; however he feels helpless when he doesnââ¬â¢t have enough money to pay the doctor for the treatment. The story reaches its climax when Kino finds a huge pearl in the sea which he perceives as a life changing chip towards an extravagant lifestyle. However, as soon as the news reaches the people of the town conspiracies and evil plots overhaul the scenario, and a serious threat strikes Kino owing much to the valuable asset he now owns. Bewildered by the situation, his partner Juana steals the pearl and throws it into the ocean, and when Kino discovers the fact he leaves her back to the ocean, and only takes her back when she recovers the pearl. Soon, they decide to leave for the capital as they werenââ¬â¢t getting the desired value for the pearls in the town and on their way they come across trackers who end up killing their son. Hopeless and full of regret, the couple returns to the town and Kin o throws away the pearl into the ocean himself, as he realizes how the greed corrupted his soul and brought him to the edge of the life he was standing on then. He then remembers the words of his father describing how bad things are bound to happen when the station of life is disturbed. The book can be analyzed in many different layers and all of them carry distinct messages regarding the possession and the pursuit of wealth. Every character is symbolic for a value or for an element of lust, and every phase of the story is unique for the essence it portrays reflecting the evils associated with capitalism. The title of the novel in itself symbolized the message he wants to convey, i.e. a pearl can be associated with many different values or even assets. A pearl can symbolize beauty, at the same time wealth and lust as it possesses the shine as well as the monetary value which anyone would drool for. The title is the perfect choice for the writing as it complements the theme of the bo ok, and provokes the readers as the interpretation is left totally upon the readers. The story is merely a journey of a mediocre individual who is a part of a larger social spectrum, living in the town called La Paz situation in Mexico, who strives hard to cash the pearl he finds in the ocean but in the struggle he ends up losing everything, and is left with nothing but regret. The story in itself is a depiction of the perils of capitalism, as it defines the perimeters of a good life not by virtue of emotional satisfaction in fact by acquiring a lot of wealth to be able to afford the luxuries of life. Capitalism is itself a corrupt system, as it creates class differences in the society where the worth of an individual is weighed against the amount of money they own. This creates a feeling of restlessness amongst the individuals who lie at the lower end of the spectrum, thus in the struggle for acquiring money they tend to corrupt themselves in order to comply by the system. That is exactly what Kino did, as he was helpless against the power which money carries, and the greed compelled him to even kill people who came in his way. Thus, Kino is a perfect illustration of a pure individual who ends up losing his values and even his child as he gets corrupted by the corrupt system. It all started when the doctor refused to treat his child as he was demanding a higher amount as his worth was much higher. The doctor is representing the powerful and the corrupt segment of the society who controls the resources

Case summary Assignment Example | Topics and Well Written Essays - 250 words
Case summary - Assignment Example Despite its success in early periods of operation, LEGO faced some internal issues which jeopardized its competitiveness in the market. Between 1998 and 2004, the company registered massive revenue loss linked to inefficient manufacturing and distribution systems of the company. The management ignored production costs, which led to high volume of wastes. The company has developed a complex operation mechanism, courtesy of its many operating years. This only meant an increase in operation costs associated with its supply chain and production sections. There are a multiple issues facing LEGO, which need strategic planning in order to overcome. First, the company faces stiff competition from other companies entering the building toy industry. Some companies even manufactured plastic bricks products attuned to LEGOââ¬â¢s products. The situation worsened in 1988 when the companyââ¬â¢s plastic design patent expired, reducing competition barrier in the industry. Second, acquisitions, for example Disney acquired Marvel Entertainment increasing the pressure of competition on LEGO. Third, legal battles also threatened the companyââ¬â¢s efficiency. Court fights with other companies such as MEGA Brands over trademark registration resulted into massive loss for the
Internet Critique Essay Example for Free
Internet Critique Essay Internet is an incredible and enormous source of information and, thereby, information searched on Internet must be evaluated for credibility to effectively serve the variety of users. This paper provides a critique of the website ââ¬Å"Healthlineâ⬠, according to the criteria of Thede and Sewell (2010). Healthline is one of the popular website among Internet users, that offers users to search for health topic and medical advise online (http://www.healthline.com). The users can find different treatment options available for a diagnosis as well as information about the drugs. It also allows the users to search for a specialist depending on their residential area. The criteria illustrated by Thede and Sewell (2010) is important in guiding users to differentiate between reliable and unreliable information. By using this criteria users become knowledgeable about evaluating the credibility of a website. The questions posed in the checklist prompt critical thinking process, and leads us to find the underlying intent of the website. The criteria assist users to check the validity of information by finding if the information is peer-reviewed or verified by qualified editor. Only if the found health information were from a valid scholarly source then it would be trusted. If the userââ¬â¢s intent is to validate the information then this criteria should be applied to any other website regardless of the underlying intent. For instance, commercial websiteââ¬â¢s sole intent is to sale their products. The Internet users now can search on the web for other websites that offer peer reviews on that product. Source Healthline runs by a company Healthline Networks Inc. Originally founded in 1999 but re-launched in 2005 with current name. Detailed description is given about the companyââ¬â¢s motto, board of directors and management team in company-info section. A search for a specific disease results in a choice to go to different websites or choose the articles that are listed. If the editorial team does the article then no author name is specified, but itââ¬â¢s reviewed by a qualified MD with or without their credentials specified. But if the article is from an encyclopedia or another publisher, there is only author name is given with their affiliation and articleââ¬â¢s published date but no authorââ¬â¢s credentials. The last review date of an article is shown at the bottom of the page. The publisher name is shown as well with the copyright information. If author name is displayed, there is no link to contact the author. The link is available if the article is licensed from another publisher. There is no link available to contact the article reviewer. Funding Healthline is found to be a commercial site, generating its revenue mainly from the advertisement. Itââ¬â¢s a free website for users. The home page is attractive and shows the advertisement at top and bottom of the page. There is also video advertisement with no audio, resulting in less distraction. The advertisements are clearly labeled and donââ¬â¢t spoil the user experience, therefore making the navigation easier. Validity and Quality The home page of Healthline shows the accessed date on top of the page and copyright information at the bottom. The last reviewed date is displayed at the bottom of each individual article. New articles are shown at the home page with the name of the editorial team member on top. But if user is looking for something specific then some of the articles searched are almost two years old. User has to thoroughly search for up to date information. There are appeared to be no content and typing errors. Information appears to be non-bias. The language used is comprehensible to a general user and lacks the jargon terms. If user navigates to the company info, the purpose of the website is clearly stated. Some of the articles are written by the editorial team and reviewed by an MD with published date but no credentials, while other articles are sourced from a third party publisher with some links functioning. The website claims that articles that are done by Healthline editorial teams are reviewed by the board of certified physicians and medical editors. Detailed information about Healthline medical advisory board and their editorial team is also available on the website, including the name of each member with brief summary of their credentials. Healthline acknowledges licensing the medical and health content from third parties for publication, with clear depiction of their name and a valid link. Some of their third party publisher reference partner include A.D.A.M., GALE Cengage Learning, Gold Standard, NBC Universal, StayWell, Harvard Health Publications, Reed Elsevier and more. Privacy Healthline privacy policy is well outlined in the company-info section. They clearly state what information they are collecting from users and with whom they share this information with. They gave a detailed overview of what type of anonymous information they are collecting. Anonymous information includes the type of queries done on the website by a user, but doesnââ¬â¢t include any personal information such as, name email-address or phone number. User can choose not to pass-on this anonymous information by disabling the cookies. Healthline pledges not to share any personal information of registered users to the third parties. In comparison to the recognized privacy policy statement of HON (Health on The Net Foundation, 2011) website, the personal information collected is also not shared with any third party. However, HON also gathers ââ¬Å"non-personalâ⬠information using their web-server. HONââ¬â¢s privacy statement is short and lacks the details about the non-personal information. On the other hand, Healthline company-info section not only clarifies in detail to the users what are the ââ¬Å"Cookiesâ⬠and ââ¬Å"Web Beaconsâ⬠, but also specifies the privacy policy for the children under thirteen. Summary To summarize, the criteria by Thede and Sewell helps user develop a sense to evaluate the sources and credibility of information, based on authorââ¬â¢s qualifications and credentials, source of publication, websiteââ¬â¢s purpose, and websiteââ¬â¢s privacy policy. All of the criteria are found to be of most importance in helping user to evaluate a website for credibility, especially if user is searching information about their health. The healthline doesnââ¬â¢t meet some of those criteria. The criterion of source is not met because of the lack of consistency in providing authorââ¬â¢s name and credentials. Healthline needs to develop a consistency in displaying authorââ¬â¢s name, credentials, affiliation, link to contact the author, articleââ¬â¢s last reviewed date, and link to contact the article reviewer. The validity and quality criterion is also partially met. The third party publisherââ¬â¢s validity is verifiable in some case where links are functioning. Healthline needs to specify credentials of the article reviewers as well as the name of their editorial teamââ¬â¢s member who wrote the article. Also the health information needs to be up to date. Healthline meets the criteria of funding and privacy policy. It clearly expresses its purpose, and acknowledges generating revenues form advertisement. Its privacy policy gives user a detailed view about the anonymous and personal information and how it is used, gaining userââ¬â¢s trust.

The Success Of Google Maps
The Success Of Google Maps Google Maps a free web mapping service application and technology provided by Google. It offers street maps, a route planner, and an urban business locator for numerous countries around the world. Google Maps can generate driving directions between any pair of locations and can also show turn-by-turn instructions, an estimate of the trip time, and the distance between the two locations. To be able to embed Google Maps into web pages for either more elaborated customization, we need Google Maps API. Google API stands for Application Programmable Interface. As its name implies, it is an interface that queries the Google database to help programmers in the development of their applications. [By definition, Google APIs consist basically of specialized Web services and programs and specialized scripts that makes it possible for Internet application developers to better find and process information on the Web. In essence, Google APIs can be used as an added resource in their applications. In the real world, application programmers, developers and integrators write software programs that can connect remotely to the Google APIs. All data communications are executed via the Simple Object Access Protocol (SOAP), which is a Web services standards as defined by the industry. The SOAP protocol is an XML-based technology meant to easily exchange information entered into a Web application. Googles API can better help developers in easily accessing Googles web search database. This empowers them in developing software that can query billions of Web documents, constantly refreshed by Googles automated crawlers. Programmers can happily initiate search queries to Googles colossal index of more than three billion pages and have results delivered to them as structured data that is simple to analyse and work with. Additionally, Google APIs can perfectly access data in the Google cache, while at the same time provide checking in the spelling of words. Google APIs will more precisely implement the standardized search syntax used on many of Googles search properties.] The map data in Google Maps is compiled by a private company with whom Google have a partnership. This company is Tele Atlas and they are a world leaders in navigation and location-based services. The maps are highly accurate and have been praised for recording extremely rural areas and mapping the terrain correctly. Google Maps also coordinates with several other in-house application currently run by Google. The most obvious of these is Google Earth. The two services use each others data for coordinating satellite imagery and in updating newly-developed areas which have yet to be updated on both databases. Business and premises which are place-marked on maps have been supplied by directory listings. In the US, Google say that they use Yellow Pages directories but also mentions, We arent currently able to share our full list of U.S. Yellow Pages sources. All other premises and place-marks are shared by users which we will take a look at next. The technology behind Google Maps could generically be described as a map server. The map server generates a map for the requested location from a large set of pre-generated map tile images covering the entire planet. The map server may overlay data from other databases on top of this. The combination of a map viewer client and geographical database is traditionally called a Geographical Information System (GIS). A bit more detail, google maps uses a big div element to contain several img elements. each of those img elements is 256 pixels square, and is positioned on a regular grid. from there, the google maps javascript program calculates which grid images should be loaded into each img tag and uses regular dom manipulation to position each img in the right place. Only the tiles of the map that would be visible inside the div are loaded. when you scroll off the side, the javascript library unloads the image, and loads new ones as needed. Other elements, like the zoom controls, markers, and lines, are stacked or drawn on top of that as needed. Overlays are objects on the map that are tied to latitude/longitude coordinates, so they move when you drag or zoom the map. Overlays reflect objects that you add to the map to designate points, lines, or areas. The Maps API has several types of overlays: * Points on the map are displayed using markers, and often display a custom icon. Markers are objects of type GMarker and may make use of the GIcon type. * Lines on the map are displayed using polylines (representing a collection of points). Lines are objects of type GPolyline. * Areas on the map are displayed either as polygons if they are areas of an arbitrary shape or as ground overlays if they are rectangular. Polygons are similar to polylines in that they consist of a collection of points with a closed loop and may take any shape. Ground overlays are often used for areas that map either directly or indirectly to tiles on the map. * The map itself is displayed using a tile overlay. You can modify this with your own set of tiles by using a GTileLayerOverlay or even by creating your map type using a GMapType. * The info window is also a special kind of overlay. Note, however, that the info window is added to the map automatically, and that there can only be one object of type GInfoWindow attached to a map. Each overlay implements the GOverlay interface. Overlays can be added to a map using the GMap2.addOverlay() method and removed using the GMap2.removeOverlay() method. (Note that the info window is added by default to the map.) GPolyline objects use the vector drawing capabilities of the browser, if available. In Internet Explorer, Google Maps uses VML (see XHTML and VML) to draw polylines; in other browsers SVG is used if available. In all other circumstances, we request an image of the line from Google servers and overlay that image on the map, refreshing the image as necessary as the map is zoomed and dragged around. Google Apps Script privilege users with a new level of control over Google products. One can now access and control Google Spreadsheets and other products using ones own JavaScript scripts. Unlike browser-based JavaScript, the scripts you write run directly on Google servers in order to provide direct access to the products they control. These scripts interact with Google applications such as Google Spreadsheets, Google Finance, and Google Sites, and enable varying degrees of interactivity among the applications. Google Apps Scripts is powerful and flexible enough to be used to accomplish a wide range of different tasks, but its also easy enough to use that you dont have to be a programmer to create scripts. ================================================== The Google Apps Script language is JavaScript, with objects and methods that are unique to Google Apps Script. These objects and methods give the scripts access to Google Docs and Spreadsheets, Gmail, Google Finance, and other Google applications. Youll read more about objects and methods in Using the Google Apps Script APIs. Scripts are saved and run from an associated Google Spreadsheet. You can save as many scripts as you want to a particular Spreadsheet, then run them at will. The data your script works with is typically stored in a Google Spreadsheet, but you can retrieve information from many external sources, including web pages and XML sources. You can use Google Apps Script to create email, spreadsheets, pages on Google Sites, and files in the Google Docs Document List. The instructions in a script are grouped into functions. Each function performs a section of the larger task your script accomplishes. For example, if you write a script to manage your budget, the first function might display custom menus in the Spreadsheet and the second might pop up a dialog box that you use to insert additional information into the Spreadsheet. Google Apps Script provides a robust API (Applications Programming Interface) of objects and methods that you use in your scripts for such tasks such as displaying a dialog box, creating a calendar event, creating a page on a Google Site, and many other activities. The Google Apps Script API document is here. ========================================================= The JavaScript class that represents a map is the Map class. Objects of this class define a single map on a page.More than one instance of this class can be created since each object will define a separate map on the page. When creating a new map instance, specify a HTML element in the page as a container for the map. HTML nodes are children of the JavaScript document object, and we obtain a reference to this element via the document.getElementById() method. This code defines a variable (named map) and assigns that variable to a new Map object, also passing in options defined within the myOptions object literal. These options will be used to initialize the maps properties. The function Map() is known as a constructor and its definition is shown below: ========================================================= While an HTML page renders, the document object model (DOM) is built out, and any external images and scripts are received and incorporated into the document object. To ensure that the map is placed on the page after the page has fully loaded, the function, which constructs the Map object once the element of the HTML page receives an onload event, is executed. Doing so avoids unpredictable behavior and gives the user more control on how and when the map draws. The body tags onload attribute is an example of an event handler. The Google Maps JavaScript API also provides a set of events that one can handle to determine state changes. ============================================================================================ The maps on Google Maps contain UI(User Interaction) elements for allowing user interaction through the map. These elements are known as controls and variations of these controls can be included in a Google Maps API application. The Maps API provides built-in controls which may be useful when creating a map: The Navigation control displays a large pan/zoom control as used on Google Maps. This control appears by default in the top left corner of the map. The Scale control displays a map scale element. This control is not enabled by default. The MapType control lets the user toggle between map types (such as ROADMAP and SATELLITE). This control appears by default in the top right corner of the map. controls cannot be accessed or modified directly. Instead, the maps MapOptions fields, which affect the visibility and presentation of controls, is changed. ===================================================================== can be calculated by using the DirectionsService object. This object communicates with the Google Maps API Directions Service which receives direction requests and returns computed results. The user may either handle these directions results himself or use the DirectionsRenderer object to render these results. Directions may specify origins and destinations either as text strings (e.g. Chicago, IL or Darwin, NSW, Australia) or as LatLng values. The Directions service can return multi-part directions using a series of waypoints. Directions are displayed as a polyline drawing the route on a map, or additionally as a series of textual description within a element (e.g. Turn right onto the Williamsburg Bridge ramp). ====================================================================== The Elevation service provides elevation data for locations on the surface of the earth, including depth locations on the ocean floor (which return negative values). If Google does not know the exact elevation value, it uses four nearest locations and returns the avareged value. The ElevationService object provides you with a simple interface to query locations on the earth for elevation data. Additionally, you may request sampled elevation data along paths, allowing you to calculate the equidistant elevation changes along routes. The ElevationService object communicates with the Google Maps API Elevation Service which receives elevation requests and returns elevation data. ============================================================= The SDK includes two SWC files, a Flex version for use within FlexBuilder (or with the free Flex SDK), and a non-Flex version for use within Flash CS3. The Flex *.swc is denoted with a _flex suffix in the filename. These SWC files contain interfaces for all public classes in the Google Maps API for Flash development environment. Compiling your application with this library ensures that it can utilize and communicate with all public functionality of the runtime Google Maps API for Flash library, which is retrieved from Googles servers whenever a client loads your application. ============================================================ The Google Earth Plug-in and its JavaScript API let you embed Google Earth, a true 3D digital globe, into your web pages. Using the API you can draw markers and lines, drape images over the terrain, add 3D models, or load KML files, allowing you to build sophisticated 3D map applications. If you have an existing Maps API site, you can 3D-enable your page with as little as one line of code.

My Dominant White Culture Essay example -- Cultural Identity Essays
In my culture, the environment is clean. We have clean houses, clean community spaces, and clean schools. We tend to avoid places that are dirty. Global Workforce Integration Essay -- Labor Outsourcing Integrating Es
Global Workforce Integration Outsourcing, offshoring, and workforce globalization. Those words were voiced late 1999 in Seattle inside and outside the World Trade Organization meeting. Damages in Seattle amounted to $2.5 million, and 500 plus protesters were arrested. 3 In those days, outsourcing was about moving manufacturing jobs to developing countries to take advantage of the lower salary there. The affected blue-collar US workers were acting violently out of anger and frustration since their jobs were taken away. White collar population didnà ¡Ã ¯t voice any opinions about the issue back then, since US had the largest demand for white collar workers. Today, white collar workers are feeling the pressure of outsourcing in America and starting to discuss the matter seriously. According to researchers at UC Berkeley, 1 in 10 current job positions in the US can be outsourced, while 1 in 6 Silicon Valley jobs are vulnerable to outsourcing. 4 Since software facilitates the white collar job outsourcing and software development is one field most prone to outsourcing, I will focus on the outsourcing issues related to software. I have chosen three specific computer companies à ¨C Peoplesoft, Oracle, HP à ¨C to discuss their outsourcing trends and make inferences about the global effects. In the end, I hope to arrive at a decision about outsourcing from the ethical analysis of the outsourcing issue. But first, letà ¡Ã ¯s have a look at why outsourcing is being applied to white collar job positions today. Why Outsource? A major reason for outsourcing is pay difference.
